What is Mediation in Indiana Divorce and Custody cases? Can I get a free mediator?

Mediation is a type of a resolution where you do not go to Court. A mediator – chosen by the parents or appointed by a Judge is a neutral professional who helps parties involved in Indiana divorce or child custody dispute reach an agreement. Sometimes a mediator is an attorney or a former judge who received training on assisting the parties to come to a mutually beneficial agreement. A mediator will not pick a side or provide advice. Complexity of the divorce case and the willingness of the parents to negotiate are the factors in how long the mediation can take.  You are not required to come to an agreement during a medication in a divorce or child custody case in Indiana, but you usually will be required to attempt to negotiate in good  faith.

Sometimes a family Judge will order the parties to attempt a mediation before scheduling the divorce or custody case for a Final Hearing. For the parents who can’t afford paying full price for a mediator Indiana offers reduced cost mediator options. Sometimes, if one of the spouses earns significantly more than the other, the cost of the medication can be either divided or paid by one spouse.
